Burke recently decided thatSciorra couldnt testifybecause a grand jury didnt hear evidence about the alleged incident.
Prosecutors did re-present the case to a grand jury, hence todays developments.
While Weinstein isnt charged with raping Sciorra, her claim can now be used to boost their predatory-sexual-assault allegation.
Prosecutors want to consolidate both indictments.
If that happens, they would prosecute the revamped predatory-sexual-assault counts, as well as the other charges.
She also said, We believe we will be successful in pushing for the new indictments dismissal.
Asked what Weinstein was doing with his cell phone out, Rotunno said that he was turning it off.
